Terms of Service

If you are accessing or using the Service on behalf of an entity, you represent and warrant that you are at least 18 years of age, and that you are authorized to accept this Agreement on such entity's behalf. Such entity agrees to take responsibility for the use of the Service in compliance with this Agreement.

The website may offer login via third-party authentication (e.g. Google, Apple). You are responsible for maintaining the confidentiality of your login information and for all activities under your account. Sharing access to your account with others may result in permanent blocking of your account.

Where Paid Services apply, fees are as set forth in the applicable order or subscription. Unless otherwise specified, payment is due as stated. Fees are generally non-refundable except as required by law or as stated in the order. If you are a consumer in the EU, you may have a right of withdrawal within 14 days before Paid Services are made available to you; once Services are made available, that right may be lost.

You may not provide access to the Paid Services to anyone beyond the number of users specified in your agreement. Unauthorized sharing may result in permanent blocking of your account without reimbursement.

In connection with your use of the website, you agree not to: (a) violate any applicable law or regulation; (b) attempt to gain unauthorized access to any part of the Services or our systems; (c) infringe the rights of any person or entity; (d) interfere with or damage the Services (e.g. via viruses, denial-of-service); (e) use scripts, bots, or other automated means to collect information or interact with the Services without our express written permission, except where we provide an API and permit such use.

AppTrack Ninja grants you a limited, non-exclusive, non-transferable license to access and use the Materials (analytics, tools, content) for your personal or internal use, in accordance with these Terms. You may not copy, reproduce, distribute, republish, sell, or create derivative works from the Materials, or disclose them to third parties, without our prior written permission. We disclaim warranties as to the accuracy or completeness of any information; your use of the website content is at your own risk.

The website, Services, and all Materials are provided "as is", without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your access to or use of the Services or any Materials. Our total liability shall not exceed the amount you paid to AppTrack Ninja under this Agreement.

We may change these Terms from time to time. Your continued use of the Services after we post modified terms constitutes acceptance of those terms. The validity and effect of these Terms shall be governed by the laws of the State of Delaware, USA. Disputes shall be resolved by binding arbitration in Wilmington, Delaware, in English, under the Commercial Arbitration Rules of the American Arbitration Association.
